2016 Victories

Immigration Bond Victory: 2016: After Mexican national with a misdemeanor was denied a bond by ICE, Attorney Asma Din did a bond hearing with an Immigration Judge at the Dallas Immigration Court. She argued that our client should be granted a bond due to his fear of return to Mexico based on account of him being a homosexual male. After hearing Attorney Asma Din’s arguments, the Immigration Judge granted our client a bond.
Removal Defense Victory: 2016: Our client, a national of Honduras, was ordered deported due to her previous attorney not filing her asylum application on time. Attorney Asma Din filed a motion to reopen with the Immigration Judge where she argued that her deportation order should be overturned. Attorney Asma Din’s motion to reopen was granted by the Immigration Judge.

USCIS Immigration Application/Petition Victory: 2017: Or client, a national of Burkina Faso, applied for adjustment of status in 2012. After waiting 4 long years and going through several attorneys, our client retained our law office to handle his adjustment of status case with USCIS. At the interview with the USCIS officer, our immigration attorney presented the officer with over 100 pages of documentation in support of our client’s adjustment of status case. The USCIS officer approved him for adjustment of status and he was issued a green card shortly after his interview.

USCIS Immigration Application/Petition Victory: 2017: Our client, a citizen of Jordan who was living in Qatar, retained Attorney Asma Din after his I-130 petition from his U.S. Citizen wife had been pending for over a year and he urgently needed to come to the U.S. to start his medical fellowship. Attorney Asma Din immediately called USCIS to place an expedite request over the phone and shortly after she placed the request, our client’s I-130 was approved by USCIS. Attorney Asma Din then placed another expedite request for our client to quickly obtain an interview with the U.S. consulate. This expedite request was also approved and our client was granted his visa and green card.

This ankle monitor prevented our client from working and providing for his family. After negotiating with Dallas ICE officials, Attorney Asma Din was able to convince ICE to remove the ankle monitor.

Immigration Attorney Asma Din filed an I-601 waiver where she argued that our client’s equities outweighed the misrepresentations. USCIS granted our client’s I-601 waiver.

2018 Victories
USCIS Immigration Application/Petition Victory: 2018: Our client, an Iraqi Citizen and national, initially contacted us after his father had petitioned for him and he had been stuck at the NVC phase for over a year. After being hired on the case, Attorney Asma Din was successful in getting our client through the NVC phase and through his visa interview in which he was granted a visa. Our client is now in the U.S. and a green card holder.
USCIS Immigration Application/Petition Victory: 2018: Our client, a Mexican national, contacted our law firm to help file an I-601A waiver based on the hardship his U.S. Citizen wife would face. Attorney Asma Din submitted a 250 page waiver packet to USCIS. The I-601A waiver was approved by USCIS.

Deportation Defense Victory: 2018: Our client, a Legal Permanent Resident who was a citizen of Iraq, was placed in deportation proceedings after he took several felony convictions. Attorney Asma Din submitted over 500 pages of evidence in support of his cancellation of removal case and his asylum case as well as a legal brief detailing the reasons why the Immigration Judge should grant his case. At his trial, Attorney Asma Din successfully convinced the ICE attorney and the Immigration Judge that our client should be granted Cancellation of Removal. Our client was released from Immigration custody and is now home safe and sound with his family.
USCIS Immigration Application/Petition Victory: 2018: Our client, a U.S. Citizen, retained our law firm to file a concurrent I-130/I-485 petition for his mother who entered under a B1/B2 visa from Pakistan. Our client had huge financial responsibilities and needed his mother’s green card to be approved sooner than the normal processing time. Attorney Asma Din placed an expedited processing request on the case with USCIS which was approved. Our client’s mother received her green card approval less than three months after we submitted her adjustment of status application.
Deportation Defense Victory: 2018: Our client, a Vietnamese citizen, entered the U.S. as a refugee and obtained a green card. After receiving some bad advice from his public defender, our client took a conviction which qualified as an “aggravated felony” for immigration purposes and resulted in his deportation order. After waiting 10+ years, our client received a full and complete pardon for his conviction from the Nebraska Board of Pardons. We filed a motion to reopen sua sponte with the Omaha Immigration Court where we argued that the Immigration Judge should use his sua sponte authority to terminate his deportation order. These motions are very rarely granted and we are happy to report that the judge granted our motion. Our client is back to having his green card status.

The Harlingen Immigration Judge agreed with Attorney Asma Din’s arguments and granted our client’s motion to reopen. Our client is no longer in fear of deportation.

The Dallas Immigration Judge agreed with Attorney Asma Din’s arguments and granted our client’s motion to reopen. Our client is no longer in fear of deportation.

Attorney Asma Din was retained to fight his case before the immigration court. She was successful in getting his Cancellation of Removal case granted/preventing deportation and he now his back to having his green card status.

Deportation Defense Victory: Our client, a national of El Salvador, received a deportation order for failure to attend immigration court when she was a minor. She subsequently married a U.S. Citizen who was physically and emotionally abusive to her. She hired Attorney Asma Din to fix her status. Attorney Din filed a VAWA petition which was approved. After the VAWA was approved, Attorney Din reached out to the Government attorneys who agreed to join in a motion to terminate her deportation order. Our client is now in the process of obtaining her green card.
